The Box Is Now a Legal Document
Two months into PPWR, the hard part isn't making compliant packaging. It's proving what your packaging is, and keeping that proof true as things change.
Since August 12, 2026, every packaging type placed on the EU market needs an EU Declaration of Conformity (DoC) backed by a technical file. That is the core of the Packaging and Packaging Waste Regulation (EU 2025/40), or PPWR. Stock already in the pipeline got no grace period.
This isn't a timeline or a software pitch. It draws on people living through implementation, and on what we see from the press side, where packaging specs get made and quietly changed. We print boxes; we're not your lawyers. Have counsel sign off on the calls that matter.
What PPWR feels like from the inside
A forty-cent carton can hold a sixty-dollar product at the border
Non-compliant packaging now means the packaged good can't be sold in the EU at all. Anthesis consultant Hannah Worthington adds that a finding in one member state is reported to every other one you sell into.
Nobody owns it
When PPWR landed on Marwan Elsaifi's desk as a packaging manager, regulatory said they only handled REACH. Global sustainability said it was a European problem. In a June 2026 Simvia survey, 38% of food and consumer goods companies said PPWR sits solely with Quality Assurance. Average readiness confidence was 35%.
Your supplier's silence is your liability
In the same survey, 49% said suppliers are slow or don't respond. The Commission's June 2026 guidance is clear: each packaging item has one "manufacturer," normally the brand on the box, and it carries sole legal responsibility. "My supplier didn't give it to me" no longer counts.
The deadline is the customs dock
For imports, what counts is release for free circulation. The PFAS limits came with no sell-off period for older stock. Add four to six weeks of ocean freight, and a China-made box's real deadline is earlier than the regulation's.
Small sellers are leaving
Within weeks, several independent tabletop publishers stopped shipping to the EU. They were weighing each country's EPR fees against their sales there.
The file rots
Consultant Anna Perlina calls PPWR a data management project in practice. Keeping the data current is harder than collecting it. In contract printing, a swapped board grade, a new adhesive lot or a remixed spot ink each quietly changes what your DoC describes.
Five things most PPWR guides get wrong
| What you'll often read | What the regulation and Commission guidance say | What it means |
|---|---|---|
| "Our supplier is FSC, ISO 14001 and SMETA certified, so we're covered." | None of these certify conformity with PPWR. They cover fibre origin, environmental management and labour. PPWR asks what the packaging is and whether you can prove it. | Keep the certificates for retailers. Don't treat them as PPWR evidence, including ours. |
| "Double walls and false bottoms are banned since August 2026." | The Commission says Article 10 on minimisation applies from January 1, 2030. The existing EN 13428 standard governs until then. | No emergency redesign, but design your next refresh to the coming limits. |
| "Recyclability is a 2030 problem." | Article 6(1) has applied since August 2026, judged under the old criteria (EN 13430). The formal design-for-recycling test comes later. | You must already be recyclable. The formal assessment comes later. |
| "Premium and gift packaging is dead." | Marketing alone can no longer justify extra material. But Annex IV counts gift and seasonal sale as part of a pack's function, and recyclability can justify weight. | Premium survives. Argue it on function, not shelf impact. |
| "PFAS means lab panels on every SKU." | For food-contact packaging, including pet treats, the Commission says a total fluorine result under 50 mg/kg can be considered compliant. | Screen first. Escalate only what fails. |
The five locks
"Collect your data" is true and useless. The order you work in matters more than the effort.
1. Draw the boundary before you draw the box
PPWR regulates packaging, not products. Function decides which an item is: does it contain, protect, deliver or present the product, or is it integral to it? For games, puzzles and collector editions, this is the biggest call you'll make. Josh Fox of Black Armada noted that swapping shrink-wrap for a tuck box might take a card deck out of scope: "we might end up producing additional packaging to meet these regulations." Decide component by component, write down why, and have counsel confirm. That reasoning is page one of your technical file.
2. Name the signer before the first PO
There is one manufacturer EU-wide: whoever's brand is on the packaging. Separately, there is an EPR producer in each member state where the packaging becomes waste. Outside the EU, your importer must be an EU-established legal entity; a branch office doesn't qualify. Settle this before you scope your portfolio.
3. Freeze the spec, not just the supplier
A DoC covers a packaging type, and a type is defined by its material stack: board grade and mill, every ink, coatings and laminates, adhesives, and any foils, windows, magnets or inserts with their weights. Lock that stack in the contract: no substitutions without notice and updated evidence.
Ink choice matters here. Every custom spot ink is a separate formulation that needs its own heavy-metal evidence. A fixed process ink set means one ink dossier serves every SKU. Our 7-color ECG press covers about 82% of the Pantone library with the same seven inks.
4. Write your 2030 argument now
CEN's updated minimisation standard is set to include maximum weight and volume limits for common formats. Recyclability also moves to grades by weight: A at 95% or more, B at 80%, C at 70%. On rigid and collector boxes, magnets, EVA foam, PET windows and metallised lamination all reduce the share of fibre. The paper industry alliance 4evergreen recommends hot or cold foil over metallised film. Justify each premium feature by protection, gift function or recyclability. Fold the changes into your next artwork refresh.
5. Run the clock from the dock
Plan backwards from customs release, and know which rules allow sell-through.
| Requirement | Applies from | Grace for earlier stock |
|---|---|---|
| PFAS limits (food contact) | Aug 12, 2026 | None |
| Minimisation (Art. 10) | Jan 1, 2030 | Not specified |
| Harmonised sorting label (Art. 12) | Aug 12, 2028 or later | Up to 3 years |
| Design-for-recycling test (Art. 6) | Jan 1, 2030 or later | Not specified |
Once harmonised labels apply, national sorting marks can't sit beside them. Budget an artwork pass per SKU.
What a factory can and can't do
A factory can't make you compliant. Article 16 does require suppliers to give you the data you need, and that is where a factory earns its place.
| A factory can't | A factory can |
|---|---|
| Sign your Declaration of Conformity | Deliver a per-SKU material stack with weights and fibre share |
| Decide if your game box is packaging or product | Show how each construction choice moves that line |
| Act as your EU importer or EPR producer | Commit in writing to notify you before any substitution |
| Turn a certificate into PPWR evidence | Tie heavy-metal and fluorine test reports to your exact spec |
Our certifications still answer real questions. FSC Chain of Custody (BV-COC-129082) covers fibre origin, ISO 14001 covers environmental management, and SMETA covers labour standards. Recyclable, plastic-free folding cartons, FSC substrates, molded pulp and soy-based inks are in standard production.
